Hey guys. Question for those EBay sellers out there.

I have been an Optician for the past 3 years, and have sold Authentic Designer sunglasses on Ebay for the past few months.

I had listed about 9 Chanel sunglasses that I had ordered from the COmpany I work for. It is Luxottica, which manufactures Prada, Chanel, Bvlgari, D&G etc.

I work for the company and ordered them, so I know beyond a shadow of a doubt that the sunglasses are real.

In listing the sunglasses, I used my own pics and showed Every detail of the sunglasse incl. Model number and the ID number that some of the glasses have watermarked on the lenses.

Yet EBay ended all of the auctions siting "Misuse of Trademark."

They also suspended my acct for 12 months, and wont give me a single reason why.

Has anyone else had this type of problem before. I know tons of fake stuff gets sold on Ebay everyday, But I work for the company that makes them and I am just utterley baffeled with EBay right now.

Any advice or anyones 2 cents would be appreciated!

Its very hard to say, But more then likely some one reported you to an ebay customer rep and he took action based on his belief.
Did you get an email from ebay stating why? If not You can send an email to ** Link Removed: Only Available to Registered Members** to get more info.

Right now due to the large amount of fakes on the net. Top designers actually now have hired positions of people that will search ebay all day long as part of thier jobs to find items they deem to be fake. Then when they spot something they report it to ebay security. Since these people are actually representitives of the manufacturers and the designers, Ebay takes them very seriously.

These people are called VeRo members.
VeRO Members are protecting the name and rights of the company. When the VeRO God deems your listing to be a fake, eBay by law must comply with the trademark holders request to have the item removed. Trust me, eBay does not want to remove listings, they collect their fees from the listings.

Right now due to 90% of the supposed Authentic Stuff being sold on ebay being fake the actuall manufacturers are threatening Legal action against ebay for being the prime trading spot for illegal merchandise. If you can contact the company that manufactured the product to help you verify the product the actuall company might help you fight ebay on thier decision.

But to be honest the best thing to do is contact an ebay rep and try to work things out with them.

Im very sorry this has happend to you. It is also One of the reasons I steer clear of the designer crap. Ive had issues in this department as well


Note: If you have paid factory recipts of purchase for these items and you fax the copys to ebay. Ebay will reactivate your account.
And make you take a special training course to be able to relist the items in question. But ebay reps will tell you you should include photos of the recipts in your auctions.

A copy of your luxottica Group Invoice and recipt would get your account unbanned in 1 day.

If you currently dont have the copy then you can contact luxottica using this web address and state your dillema with them.

I have had similiar problems with ebay, but I have also spent a great deal of time on ebay looking for fraud, so I do have a little insight for you. Maybe it will help maybe not.

DO NOT USE words in your ad, that have meanings that relate to "replica". Matt is also correct with his information as well. But one thing you can do is NOT use your own photos, it can cause a problem with ebay. The only time I ever run into problems with ebay is when I mix commercial photos and my photos.
If I use commercial photos only, I never have problems. But make sure that company Logos are not present in the photo, other than on the product or product case itself.

Matt is correct your ebay competitors will turn you into ebay if they can. Many ebay sellers are really nasty people. They will have spare ebay names so they can bid on they're competitors products and never pay, which kills your product and leaves they'res available for sale. This is a common practice, and ebay does nothing to stop it.

One last thing to mention, don't mention in your ad that the commercial photos are not yours. Even though many ebayers do this, it is in direct violation of ebay policy.

This is more my two cents worth but my mate continuously has a Fire Patch removed from there Ebay because its deemed to resemble the current. They even tried the whole "this patch does not replicate the current patch" ( which it doesnt not even calle the same thing. Anymore) and ebay even pointed out it is not replicate it is resemble. I personally think that as well as people hired to check ebay you have other sellers reporting you were they can because they think your on their "turf". Anyway its annoying espessially when you have current police patches being sold on there nearly every day of the week.
I know this has nothing to do with sunglasses and I dont doubt they are the genuine article I guess my point is that Ebay sometimes goes over board with there roles and policy. I cant belive they suspended your acc. Thats not really fair at all. My mate has about 6 alerts at moment and I have been waiting for them to do the same thing.
Its funny in a not funny way that you do one thing not wrong and get booted for 12mths and yet he has 6 alerts that I know of all for the same thing and occasionally gets suspended for a day.
Ebay is a great place but stuff like that irks me big time and I imagine it has irked you too...

Sent my invoices from Luxottica to Ebay, still haven't heard back from them yet. A little frustrating.

Bust as a side note, had a family member sign up for ebay, everything in her name. And I put up the Exact same auctions, Guess What .... They Sold!!

So I guess the last laugh is on them. Even though I sold the sunglasses, it is annoying b/c my other acct had a higher feedback rating and I usually get higher bids b/c of it.

All well, better to have them sold then to be collecting dust in my room.

WORLD WIDE WEEK OF STRIKE, ebay is so rediculars they forget where they came from and who is carrying them, if everyone stopped selling on ebay and went elsewhere, sure you would be out of pocket for abit, but i bet ebay soon would respect their sellers and drop fees down

Doubt that ebays fees arent that bad if you consider the market your putting your products in front of. Try selling on yahoo. Then youll know what getting ripped off means lol

I had the same problem trying to sell a nintendo game, ebay kept deleting my listing saying I was infringing of the name nintendo. How can I list my game (which is a plug and play) without telling the customers which games they are bidding on????
Funny thing is only 1 other listing for the same game and his never gets removed but mine does everytime I list it.... I think we use the same dropshipper and he is reporting my listing because he sells his for 4 times the amount I list "buy it now"
