Dropship problem with Banggood

I had someone buy an expensive $430 upair quadcopter and claim they received a used item.

They are currently using the refund process to try and get their money back. I have contacted banggood numerous times through their email and chat and basically get the same response. They will say in chat 'we got your email', 'salesman be back', 'we hurry up' etc... What happens is that I still have no resolution to my problem.

Biggest issue for me is that I have sold many quads so far and have no choice right now except to hope everything else goes ok... It has not by the way already another person has claimed a damaged package and motor on a $135 quad and asked for a return immediately after getting the package.

Really distressing being blind on both ends of a trade and not being able to even get a reply about *if* they could have shipped a used item so I could at least know *if* I have been lying when I keep telling these people on ebay that I know they were shipped a new and unused item.

FYI: its been weeks now since I was told they would get back to me about *if* the quadcopter they shipped was new. If this goes to court I will have to name banggood as the supplier.

Hi Curtiss and welcome to the forum,

I've passed this issue onto Shane in our support centre and she will follow up with Bangggod support on your behalf. In the meantime, have you asked the buyer for photographic evidence to show the condition. You want to make sure that you're not on the end of a scam with someone trying to swap items and claim a refund on you.

I have pictures! I want to believe they (the buyers of the quad) are scammers and I have let them know I think that without actually calling them scammers but when all this time goes by and I can't get an answer from banggood about if its possible a used quad was shipped out I begin to wonder. Time is ticking and tomorrow my choices become even more limited when ebay takes a closer look. I have been telling this buyer that they were shipped a new and unused item without really knowing and when ebay steps in I am not going to tell them the same. They will be told what I know... and that is that I dropped shipped an item through banggood, this buyer got the item and claimed it was broken and used, I have been defending myself to this alleged scammer by claiming that I know it is new and unused but that I don't really know anything other than I was paid, then I paid banggood to have an item drop shipped and I cant get an answer from banggood about it now that there is a problem. I contacted them first a couple weeks ago when it first occured then this buyer kind of backed off for a week or so even after threatening to get a return through ebay. I thought he 'went away' but now after waiting a week (and a week past his deadline to just give a refund) he is trying the ebay return procedure to get the money back. I would have had no problem doing my best to tell this buyer NO but I'm filled with doubts now.

OK, do the pics show the item to be in used condition?

I can't speak on behalf of Banggood, but I've never heard of them sending anything second hand and to be honest, I find it inplausable that they would. Shane has now contacted them on your behalf, so it shouldn't take long now to get some idea of what is happening.

The only reason I thought it was plausible is that sometimes things do get returned and maybe it did not get checked very well. I will upload the pics asap. He claims the first 4 pics are of the 'repaired' part then he shows 2 images of his 'other' quadcopters gimble and camera. The rest are susposeto be of the quad he was sent. I dont know if these image links are going to work or not

If this is genuine, then the only thing that does make any sense is as you have highlighted, a customer return being sent out by mistake. Banggood will be able to confirm how they track orders, hopefully they list serial numbers on orders for waranty claims. At least that way, if you have to offer a return, you can ask for a picture of that number to ensure it matches.

Actually, I don't think that's a bad idea to do now while we're waiting for Banggood. He doesn't have to know if the number is catalogued or not, so you can say that the supplier is asking you for proof of identification by way of the serial number before they can take any further action to resolve the issue. If this is a scam, then he will know he has hit a brick wall, but if he sends a clear pic of the serial number, then the situation is quite real and a waranty claim is going to be unavoidable.

Today there was another option to have ebay step in and this is what I told them.

'I can't work thing out with this buyer' <- from a dropdown list

Really all I know is that I drop shipped a quadcopter to this person and at this point I am against any refund of anykind. I was paid for this quad by the buyer then I paid banggood.com to dropship this item. I am still new to this and thought that after this persons first deadline to give a refund went by that he had gone away. A week past his deadline and he tries this. I have contacted banggood just to see *if* its possible a used item shipped out but I am all but 100% sure that it didn't.

oh SOB I think my comments to ebay when this was raised to a case are visible to the buyer. It would have been nice not to name my source directly to that person!

That's quite interesting, if he was sure of his case he could have quite easily opened a dispute with PayPal. That's the only avenue open to him to get a refund.

Have you heard back from eBay yet?

I think you should get back onto Banggood support straight away. Don't just accept that they will get someone to contact you, ask to speak to a manager right away. You need them to send you an email confirming that the product sent was brand new, not second hand and you need to get that to eBay.

Yeah, that's pretty typical of this time of year. Festival time in China and no one seems to give a danm about business, I've seen this kind of thing happen time and time again in China.

Well I got an email and it completely ignores the issue I am having... I really think that this person will agree then later say its not working as he has already said he tried connecting his other camera and gimble of an older version of this quad (not just the gimble) to this newer quad and it didn't work. Plus its not just the gimble he says does not work its both the camera and gimble which are by far the most expensive parts of this quad.

Dear customer,

Thanks for your email and sorry for the inconvenience.

For the item [SKU285709]New UP Air UPair-Chase UPair One 5.8G FPV 12MP 2K & 4K 24FPS HD Camera With 2-Axis Gimbal RC Quadcopter [ Model;4K][ Mode;Mode 2 (Left Hand Throttle)] in your order 17248268

How about resend you a new gimbal ?

Sorry again and looking forward to your early reply.

and my reply back to them

You need to read my emails and *know if you have sent out a used quad copter* to a dropshippers customer. This person claims both the gimble, camera and possibly the connections to the quad itself do not work and is insisting on a refund! I have been defending myself saying they were sent a new and unused quadcopter but I do not know and you have not answered me about if you have sent out a used item. I do not believe your festival has been going on for 3 weeks which is the time period I have been trying to communicate this to you. EBay is involved with this trade now and all I could tell them is that I have not heard back from you and still you do not answer my question. I really do not believe that a gimble is going to be good enough for this person he says the quad is broken.

OK, that's come to an unfortunate end.

I still can't see that the item was second hand, but of course it seems that it was defective and that happens. I'm assuming he didn't claim it was second hand to eBay, he more than likely just claimed a defective item and that's why they have found in his favour.

Do you know what their warrantly returns policy is?

I am sure I am in another chat that will not help but I am still trying. This left hand (the chat) doesn't know what the right hand (banggood) is doing (and vice versa) and has no idea the extent I have gone to just to try and be someone they could be reasonably sure about. This is the first chat that feels like it accomplished something but then this person tells me not to send this chat to their customer service because it will be ignored! It took all these weeks just to be told what I needed to hear and I don't believe it I think it was just me being told what I wanted to hear! Its another brush off =/

them: Hello. How may I help you?

me: Sorry I was afk, I have been asking for help for weeks and I do not get it. After 3 weeks I get a reply but its too late ebay has decided to let this person charge me for shipping and a refund that this person wants.
me: The buyer claims they received a used item with broken gimble, broken camera and the connections to the quad do not work. I have tried and tried to get an answer about if banggood would send out a used item but I got nothing and now its too late for me. 03:22:25 pm
me: I have been telling this person they received a new unused quadcopter hoping that eventually banggood would reply but they dont

them:
Dear customer,

Thank you for your reply.

We've changed the shipping method and arranged refund of the freight for you.

this reply for order 17248268

me: the gimble + camera + quad its the whole thing the buyer said was broken and like I said its been 3 weeks. A best solution now is a refund
me: I have sold other quads and there are complaints this has me worried that I will not get help with quality issues

them: but you haven't stated clearly about the solution you want

me: a refund
me: I replied again and stated only "I want a refund"
me: the best solution before it got to this point would have been for you to be able to tell me that you shipped a used quad (or not) but you didn't

them: all right, our colleague will check it and then arrange the refund to you

me: I really do want to be dropship but I do not know how things like this effect me from your point of view

them: sorry for the inconvenience

me: and I do hope I get that refund... why don't you know if an item used could be shipped out?

them: what do you mean by that?

me: I have asked many many times... this buyers claim is that he was send a broken and used item. I have asked repeatedly (again right now) if you have shipped out used item.

them: of course not used, just maybe the item was broken during the shipping

me: see if you could have told me that *before* it could have helped but now I need a refund
me: have you even looked at the emails? 03:41:17 pm

them: sorry about that

me: so if I take this person to court for fraud you will testify?
me: I am not a bad person and want to make sure you know that to
me: could you please wait for our refund ?
me: refunds are ok but seriously it sets a precendent if this person has truely stolen property this way. I would rather let the courts nail him but a refund is fine to I guess =(

them: we apologize sincerely for the inconvenience, we will make improvement in the future

me: I am going to send this chat to that same address is that ok?

them: sorry, please don't, or the colleague will ignore the email

me: how can i know this will not work against me?

them: I checked we have received your email, you can just wait for our reply is ok

me: bye

them: we will give a priority for your case

If they have no interest whatsoever in going to court they basically open the floodgates to this type of fraud/theft and leave people like me hanging =< At the same time I wonder if the buyer is telling the truth!

I was considering opening an anchor store through ebay but now I have to wonder if they will review me and then drop me and leave me hanging again. I know I can not get an answer from them! Possibly no refund either and they admit to being ignorant with emails

Called ebay to see if this return could be cancelled and he has printed a label. If that quad gets to me before the 28th he will be automatically refunded. I was told to take pictures and to send them to ebay and they may reverse that. This person on the phone was nice I think they actually looked because they saw the discrepencies in his first messages to me and how his claims of damaged evolved from one to the next. I could have been quicker with the phone!

banggood if you read this I really hope you did not lie to me about not shipping used items because this person may take it that far and I will not let a thief get away with it if I can help it. Comments from the person on the phone suggest they think he is crooked to but they didn't actually say that its my opinion. They did say that 'they' stop sometimes after printing a label and it doesn't get that far. If its not here on the 28th he will not be paid by ebay...

We've alerted Banggood support through the forum to get you some more direct assistance, but no sign of them at the moment. I assume they are also away for the festival. If we can get them involved, they'll be able to get you some personal assistance and sort this mes out. That said, it's good to see that eBay is being helpful, that doesn't always happen.

While it's entirly possible that the damage could have been done during shipping or even be a faulty product, I just can't imagine them sending out a used item. So I think the claim that it's second hand isn't right, but the question then is what that just an over reaction by the customer to the fault or is that him trying to set up a fraudulent transaction.

I think the best way forward is to inact the warranty and get Banggood to send a replacement product. So I would suggest containg them via that email contact again and request that action., Then notify eBay of those steps and that should put a stop on any refund for now at the very least.

The thing that sticks out to me is the claim of it being a second hand product, that to me sounds like someone setting up a sting. If something arrives broken (faulty), then I would expect the usual to be that the customer would inform you of the fault and request a replacement or a refund, I wouldn't expect them to claim the product is second hand.

So that's the part that I can't get my head around and not having a clue about any stock processes at Banggood, I have no clue if it's even possible that a returned product could even possibly make it back onto the warehouse shelf for shipping.

I thought it was over when ebay forced the return on me but now I have to wait and see what happens. He has to send the item, I have to receive it by the 28th, if I get it by the 28th he will be refunded, I have to document what I was sent (take alot of pics) and send them to ebay. They may or may not refund me but until then I do not know more. I replied to Yumi asking not to send the gimble to him.

When these people choose to tell ebay they have a damaged item its like I loose all my rights or ability to choose. I have another one sending me a bayangtoys x16 quadcopter as a return because of box damage and they claim a motor is broken. And another fq777 order where the buyer says his quad just spins and wont fly. Claims to have calibrated it several times... at the discount rate I am getting with all these returns I will be sunk before getting started! Even with the max discount I might only break even but I do not get that =(

they are being sent to me, there was near zero communication with banggood while this was happening so that was not seen as an option to me and I am not sure ebay would have allowed it but maybe. I can only imagine what the shipping back to china would be! Except for the fq777 (cheap quad) they all come from china.

For the expensive upair I had no choice ebay just did it with my protest.

I am wondering what would happen if I put a stop on this package to make sure I didn't get it!

With the eBay return, you need to take pics for them so you really had to have that one returned to you,. You should certainly discuss your options with Yumi in regards to that one. They should give you a credit, if not a refund, but I'm sure they will want it returned.

What I suggest you do in future is stipulate a returns policy on your listings so customers can send them directly back to Banggood and save you the extra shipping charges.

I have been kicking myself for not stating a return policy and really wonder if I would have had more control if I did.

You know I have complained a bit about being 'blind' and didn't really realize until this very moment that banggood is kind of 'blind' to. They can know I paid them and that they shipped a new/unused item but they have no documented proof of this persons return request (except for those linked images which as part of the URL include the return#). Next time I call ebay I will ask for a way to make this public or at least available to others but no idea if they will.

Yeah, a returns policy is really importnat, especially when dropshipping. It not only makes the return of a faulty product straight forward for a customer, but it usually keeps them happy as well. If they see a clear path to a resolution, they usually have no reason to then start screaming about it, so the process ends up smoother for all concerned.

Clarify what Banggood's warrantyreturns policy is and work your own returns policy around that.

Back to the email from Yumi... being told they will send a gimble really doesn't help me as the thief getting another item would just be more loot for him. What might help would be knowing that if this goes to court that I can count on banggood typing or writing a letter or something through our court system when or rather if its time stating when the quad was shipped and that they shipped the item to him unused. Not saying that will happen I have no idea what is going to happen but it might.

That said I have not contacted ebay yet I am waiting to see if this person actually sends something to me and I need to see what I get. I am assuming I will be making another phone call to ebay so I will ask them about access to this transaction then. banggood FYI I do think you are harmless in this (IE: you did not send someone junk).

Just a little clarification... I am in the position of needing to proove that banggood sent an unused item to someone and can not do this without banggood help.

Well I think at this point you need to first see the condition of the item when you get it. If it is only faulty, then you really don't have any case at all. If you get something that is quite clearly not in new condition, clearly having been used, then you should have a case with eBay, so long as Banggood will provide you with a letter confirming a new item had been sent.

You will really need to see what the condion is before you decide what to do. Getting a full refund has to be an option, but then you will end up paying shipping to return it. That may not be worth it, it might work out better to get the new gimble and then re=sell it again, but then it will be second hand and not worth as much.

So you'll have to work out what the best option is to do.

If its not one thing its another... the other quad that is a problem for me is the bayangtoys x16. The buyer said he had bad shipping damage and I allowed a return (unfortunately because of a lack of return policy it comes to me at my expense). The thing looks nearly perfect I am charging the batteries now to test how it runs. The buyer was nice enough to leave me with a rattling screw inside the quad and another screw shows unusual wear. I am contacting ebay about abuse of their return system if this flys without a binding motor like he said. I assume the screw was meant to cause the motor to fail when I try to use it!!!

IOTW someone decided they didn't want the quad and abused the ebay return policy.

actually the more I consider what I am looking at here the more problems I see... For 1 he left a note saying he bought my cx-20 months ago with a puffed battery but I have never sold a cx-20. There are old and new versions of the bayangtoyts quad I wonder if he upgraded to the newer version and gave me his old one. It does look awful new but when I look close I see some marks.

the feeback left for me was "item was out of stock" but that doesn't make sense for what has happened I think he just like to try and complicate things by adding out of place stuff like this note and that comment. heard the door open just now its time to test this quad as I have some batteries...

This was also shipped to me in a box that claims to be the upgraded version with camera but he was sold the no camera version.

sounds great I put the screw back where it belongs it flies and I already managed to crash it and put a little notch in the propeller (small not bad and it comes with 2 sets of props). About 1-1/2 months ago I did sell someone a cheerson cx33s. I really wonder if this is related because he said he and his friends would be gracious if I would give him free stuff like batteries and cases. I reported him to ebay and he went away but maybe he actually does have friends... I could just be paranoid but something is fishy.

What you should do is get a video of it working and post that to you tube, then contact ebay with the link to let them see. If it works, then his claim is blown out of the water. Make sure you clearly identify it as the one returned and I would also be tempted to send him a link to the vid as well :)

By the sounds of it, no doubt at all that something isn't adding up.

I think the most importnat thing for you is to maybe focus on getting your returns/warranty policy sorted out. If you have that covered, then you will save a lot of drama no matter if you have cheaper or more expensive items listed.

taking it out has proven to be an expensive mistake... They are not that easy for me to fly and it now rests probably in pieces on top of a county extension building. I took it up high and then it just kept drifting until it was so far away I had to take it down. I tried the home button before the sudden drop but it kept on going...

someone may be able to get it down but I have to wait for a break in the football game possibly even until monday

Now the tracking number has been provided this battle is pretty much lost. The only thing you can do now is take a look at it when you get it and see what the condition is. If it looks used, then get that letter from Banggood to confirm they only sell new products and hit eBay back up with that and images of the drone.

Yor only legal recourse would be a civil case you would need to bring against the buyer and I seriously doubt if that would be worth it.

I dont know how to get a letter from banggood. I had/have a BBB complaint where someone replied saying they had no emails from me and that it is impossible that they shipped a used item. I do not see it as part of the banggood profile yet tho

Just contact Yumi, she shoud be able to arrange that for you. You may as well wait to see the condition of the drone, if it doesn't look to be used, then eBay aren't going to take any notice of any further corresspondence any way. If it does look used, then I would be following that up.

This bayangtoys x16 quad is showing me why I lost control. I'm not experienced with quads and 1 of the speed controllers is burnt out that could be why it started drifting and would not come back. I bought new plasitc and a new battery. I may be able to fix this speed controller by using a wire as a jumper where the traces burnt. I have a question for banggood and will ask yumi. Basically I wonder if this is a bait and switch I got stuck with... there are 2 versions of this quad the one being sold on banggood has 'altitude hold' in its title and the receiver board in this quad is the same as the the receiver board they sell on banggood.com but it does not have 'altitude hold'. I matched the product numbers on the circuit boards. The reeciever board in this quad is light green the motor controller boards are more bluish green thats another reason its suspect.

This scam on ebay... I am seriously considering dedicating my time to informing the 'public' about it. If they do not refund my money I will let as many people know that buyer protection means sellers get stolen from. This bayangtoys quad is just another example... an upgraded board probably costs like $20 or something but its cheaper to buy (I meant steal) from a seller on ebay. Its dead simple...

scammer buys an item
scammer gets the item
scammer complains about damage
scammer waits and replies to seller about damage
ebay decides seller needs to accept the return (by default it seems)
ebay makes seller pay return shipping on "damaged" item
scammer ships "broken item" (or no item at all but there is a shipment)
ebay refunds the scammer with sellers money
seller can report the "crime"
ebay *may* refund if crime report number is given
scammer may have to deny allegations to police
scammer gets away with crime nothing more will be done

if this bayangtoys quad is another scam then its just a variant of the above where a real and even working item is returned but its an older less valuable and used item. I have read from ebay how untrue this is but I have experienced this first hand I know it does! They also stated earlier this year they have imporoved the system... they have no they just increased the amount of time the scam takes by 6 days.

Yes, certainly not a perfect system, but eBay has been slanted toward buyer protection for a long time now.

I'm being scammed and I don't know what I can do about it... I have his trash with torn out wires etc... I basically got his crashed quad that he tried to repair. I wish I could believe ebay will do something about this but confidence is not high. The different ages of the plastic are obvious. This gimble is yellowed and the camera is broken

Using ebay is out of the question if this is the outcome I can expect everytime. With what I have done so far with banggood I could have expected to make maybe $40 but as it is now I will loose at least $650 (minimum). I have asked Yumi for a way ebay could contact banggood to verify the order details so when I appeal the decision maybe that will change the outcome.

You have to speak with Yumi about this, see what can be done, if anything. The trouble is, if you have been scammed, then Banggood won't be able to just give you your money back. About the only course of action you really have is cival, but I just can't see that being successful unless banggood can prove that item is not the one they sent by the serial number.

If you can prove that, then eBay may even take another look at the case.

I'm really not trying to get my money back from banggood I want this scammer to be seen as the criminal he is. I am asking questions on lawyers.com about someone who has misused the consumer protection laws. There has to be a solution that does not seem like a bandaid fix or a bigger wound figuratively speaking.

The problem really isn't ebay its the consumer protection laws. From what I just read they really had no choice and have streamlined the process. No matter what return policy you state on ebay or anywhere else its meaningless as soon as the buyer claims the item is not as described. ITS THE LAW! This is basically an honor system for buyers. I keep thinking that it cant be this easy but everything I am reading on the internet suggests that it is.

If you could provide proof that the wrong item was returned to you, then you could have recaourse, but you would need pics from the buyer showing what they received and it those pics would need to be different to what they snet you. So you would need some way to vladidate the authencity of the product.

Chances are they they have gotten away with it. Cival action is going to be very difficult and I doubt there is any case at all at this point. I'm not a lawyer of course, so I may well be completely wrong.

I think you need to epak with Yumi, see what they can help you with in regards to sending you parts to repair, they may be able to give you a good price on replacement parts. I think you just need to get it running, clean it up as much as you can and resell second hand to recoup at least some of your money.

What they show in the pics is a mint condition quad copter not this worn old quad with alot of slightly yellow to very yellow plastic.

Actually just took another look at the pics and that is what they sent me but that can't be what they were sent by banggood =( The pics do not show the yellowing very well

Have you asked Banggood is they keep a record of the serial numbers of items they send for idetification, that would be solid proof if you have one with a different serieal number or any other identtifying feature that log.

I would cahse that up, that's pretrty much the only way you can prove this item isn't the one that was sent to the customer at this point and that may even not be enough now. If eBay didn't require him to provide them with the serial number before shipping, then he will be able to mount the argument that you are just showing you have a different drone, not the one he sent you.

So this may well be a dead end if that is something eBay didn't require. If that is so, then I would be speaking to eBay and asking why they allowed the customer to simply return you a different product to what you sold him by not requiring prrof of what he was sending to you. If that's the case, then there is absolutely nothing stopping anyone from just replaving a new product and sending back a beaten up old one and gettiong a full refund on their purchase.

Surley eBay have to require some evidence that the correct product is being returned and a tracking number certainly doesn't do that.

The BC people are using "certificates" and trackable mail to prevent charge backs. It would be nice to have more control about when/if I need to do something about a buyers claims. If they have bought a "certificate" this all but eliminates the problem of warranty. The fact they also get items is a miracle and separate from the payment... It puts reputation as more important than "trust based" laws that inflate item prices.

Another insult to injury... someone buys a "pocket quad" fq777 and send the messages "I don't like it" and "It's too small" then gives negative feedback saying "Very bad". Ebay only allows me to give a positive feedback!

How do you mean that eBay will allow you to give postive feedback, is that the only option left now as a seller?

Can not leave neutral or negative I only have "Leave Positive Feedback" as an option.

EDIT: Link hidden: Login to view

Apparently negative feedback for buyers has not been allowed since 2008,.. its been a long time since I sold on ebay! This is another reason I am finished as a seller on ebay.

Yeah, now it all comes flooding back to me sorry lol.

I can remember the stink that kicked up with they brought that in. I have to admit, don't sell actual products on eBay much anymore, usually only use it as a sales funnel myself these days, but when I have sold something in the somewhat recent past, I've never had a reason to leave anything but positive feedback.

So I've been very lucky with the customers thank goodness, because that would frustrate the adnoids out of me if I got stung like that..

I believe you can get the negative feedback removed by contacting eBay. I sold there for five years back when, and the guy I sold for successfully had a bad feedback removed at least once.

Awful situation you got stuck in. Sorry to see it happen to you, but I'm taking in the education on scamming customers.

I have another negative feedback on ebay... it arrived late there is nothing I can do about that I put the order in as soon as I got it and the buyer claims "its not the authentic GW007-1". I may still try dropshipping but I am done selling on ebay as they make it incredibly easy for buyers to mess with sellers this is just streamlined fraud via ebay.

First thing I suggest is you confirm with BG that it is an authentic product and then get them to send you paperwork to that effect. Pass that paper work onto the customer and keep a copy to provide to eBay in the event of them launching a complaint.

You really can't do much about a-holes beating you to death with feedback if they really want to. However, are you giving a reasnoble shipping time in your listing, which includes a discaimer that times are only estimates?

Always much better to give a shipping window, so a time beteen X and Y, whatever that will be. That then tends to keep the customer's level of expection more in check.
