if it's a good fake you can distinguish them by the serial #

I've purchased a few of the fake ipods, one thing I noticed is that the fake ipods won't work with itunes. I've had some that looked identical to ipod nano's and they wouldn't work with itunes. Ipods are the only mp3 players that can work with itunes. So thats one way of filtering out the fakes.

I'm pretty sure you can sell it on ebay if you don't sell it as an Apple Ipod or put that in your title to draw attention

Thank you for the replies.I've purchased probly over a hundred of fake ipods and have never seen one with the click wheel. I think that it is a patented design that only apple can use.
do the copy/fake ipoda have the same features like a click wheel?
also does any 1 know if they are legal.
can we sell them on e-bay.
thank you

Just on my own experiences, I wouldn't buy the copy ipods. I bought 5 ipod mini copies from China. I think that you can get away with passing them on eBay as apple ipods, but I would be careful because for me they were difficult to sell without a warranty and 3 of the 5 were faulty, one scratched, one with a broken button, and one that was in a different box and wasn't acceptable to the buyers, which made me lose money and put me off of reselling for a few months. :x
