Mine keeps being booted from ebay for some patent violation weird s**t.
Has anyone here been selling these cellphone watches and can maybe give me some advice as to why these unbranded cellphones are being removed?

May well not be an issue with the product, could be an issue with the supplier.

I'm not sure if anyone has actually had any clarification as to why their products are being targeted on this one or not yet, but there have been quite a few Chinavision sellers having the same issues with ebay over the last couple of months.

Can you post the exact reason ebay has given you for pulling the listing, might be able to shed more light on it for you.

Kind of long but:

Thank you for your recent Fixed Price listing on eBay. Unfortunately, your item(s) breached one or more of our policies and had to be removed from the site. Any associated fees have been credited to your account and any bidders on this item have been notified.

because SMS Technology Australia Pty Ltd reported it to us for violating their intellectual property rights. When eBay is notified by a rights owner of an intellectual property rights infringement, eBay must remove the item in order to meet certain legal requirements.

Why did we remove your listing?

You may not list items on eBay that infringe the patent rights of an individual or company. Such listings are both unlawful and against eBay policy.

The rights owner for the item you listed sent us a signed legal statement telling us that your item infringed their copyright, trademark or other rights. We were therefore legally obliged to remove the listing.

If you have any questions about the removal of your listing please contact the rights owners directly.

A patent is a type of intellectual property right that gives a person the sole rights to make use of an invention. The item you are posting may use this invention without their permission, thereby infringing the person's intellectual property rights.

Yeah, seems like a pretty straight forward copyright right infringement. Seen a few of these now from stock being supplied by Chinavision. Not really sure what is going on as they used to be quite a reliable supplier from all that I've ever heard.

If the complaint is legit then there is nothing you can do about it. I remember another member have this happen and approached Chinavision who kind of fobbed them off with some form letter type of response.

Anyone have any ideas what is going on with Chinavision at the moment?

But how did the Vero program even identify the listing? Since Im not using any product name it must be targeting either the pictures I used or some words or phrasing in which case I could avoid it.

Hi
My experience with Chinavasion is that they have very bad quality products,
so you better watch out to import from thees guys.

Femblad

Did you complain?
Did you send products back for credit or repair?

Everytime I have had a problem (which has not been many times) their customer service and response has been great. All you have to do is contact them and explain the problem and they have always,in my experience, been great. I sell Chinavasion exclusively when I am using Ebay.

Of course they have the occassional crap product or infringement due to the multitude of sources at their disposal that's why it pays to test buy items first.

RED ALERT! DO NOT DO BUSINESS WITH CHINAVISION!

they are scam and fraudulent. I went to their offices in shenzen, i do alot of business with China. They have very low quaslity products and they rip you off with shipping. if you don't believe me, go order something small like ONE watch, or whatever then click checkout...a 20$ watch ships for 77$ making it 99$ for a watch you cant sell for 30$ on ebay or amazon. Then you go to their chat line and they tell you same story for a month....we will talk to our shipping team and have it resolved for you in 24 hours.....but they do NOTHING.
STAY AWAY from them

Hi twentytwelve,

We replied to your other post about Chinavasion regarding this issue. Link hidden: Login to view

Kindly try their site once again, the rates you had previously seen could be a technical glitch as they claimed, and they seem to be working now. If you continue to have the same problem, please send us a screenshot and we will investigate.

There have been satisfied members who have used Chinavasion, and their reviews can be read at their supplier's profile page - Link hidden: Login to view

And more positive reviews from this post - Link hidden: Login to view

Let us know if there is anything we can do to help.
