eBay is removing my listings!

Hi, please I need help. I don't know why eBay is removing my listings. I bought some Ed Hardy caps at the mall for very good price so I start selling on eBay and they cancelled my listings because of trademark violation. But I don't understand what I was doing wrong. I see every listing of the other sellers and they look like mine. So, I don't understand and they sent me this email:

Dear ijrp58,

You recently listed the following listing:

- ED HARDY CAP HAT BRAND NEW ONE SIZE UNISEX
- ED HARDY CAP HAT BRAND NEW ONE SIZE UNISEX

The listing was removed because it violated eBay policy. All fees related to this listing have been credited to your account. We also notified members who placed bids on the item that the listing has been canceled.

The rights owner, Nervous Tattoo, Inc. dba Don Ed Hardy, notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law.

Trademark infringement is unlawful and violates eBay's policies. A trademark is a unique sign (such as a name, word, phrase, logo, or symbol) that a company uses to identify its products and/or services.

Using another company's trademark in a way that may confuse buyers about the source of goods or services, or confuses buyers into believing that the seller is affiliated with, sponsored by or endorsed by the trademark owner is both illegal and against eBay's policies. Examples include counterfeits, unauthorized replica items and items that bear the brand or logo of a company without that company's permission.

They only cancel items when other people turn you in if it violates trademark. Other wise they wont. The others you see selling the same, turn them to ebay and they will cancel theirs to I'm sure. They are probally the ones turning you in. They want competition selling the same product

I fully agree. The ones that are really turning you in is the sellers already established in this field

yes thats right, my listings started to get deleted, until I phoned up the Powerseller support line and asked who was reporting me and did they look at their account - law and behold - they were selling identical items! They wouldnt tell me who it was, however I did a quick search of the deleted items and kept a note of who was still selling - pointing to 2 other sellers, so I reported both, they both got deleted, then I left it for a few days and then 1 was selling so I put my auction up and it got pulled - so I got the only other sellers ad pulled. Then I sent them a nice request to stop having my auctions pulled because I kept getting theres pulled and it didnt happen again for this item.

You should file a formal complaint with eBay and with that complaint send them your receipts so they know your legit.

Those other eBayers are the sleaze of sleaze.

I would demand eBay do something with the false reports. At least make a record of it.

I hate this kind of crap.

I don't think it works that way, if it did then I would hire a team of people to do this daily and I'll be the only guy on eBay selling unlocked iPhones, not a bad idea if it were true. Not every item you report gets taken down, I've tried it before so the item apparently needs to be violating some type of policy.

So what u r saying is they can remove ur listings if someone else tells them its copyright? Well how do u sell anything that anyone else is selling? They have cancelled my account so many times when I use my own photo's it's crap. Is there any sellers here that will let you use their pics to sell on ebay?

Thanks for this best tips,I was also a victim of this crap.My instinct is right,someone somehow reported my items and the one who reports are competitors.My account was suspended so many times and my items were also deleted because of this annoying people.Not a very good seller and competitor.Wish them a Bad Karma.

Ebay is notorious for removing listings..All you have to do is hit the 'report' button located at the bottom of all listings and it will most likely get pulled..

According to ebay itself, they depend on 'other members' to report auctions that infringe upon the rules..If a vero reports it, it's pulled no questions asked immediately. If a member reports it, an ebay employee team is suppose to take a look at the listing and then make a decision based on what they see within the listing. However they normally just pull the listing and send you a notice..

This system is very over abused. Alot of un-ethical sellers use it as a way of eliminating their competition. They normally target new and inexpereinced sellers.

As far as using other peoples photos, I doubt that you will find many people that will let you use their photos..What you should do is buy a good digital camera and pratice with it. Also buy a cheap 'shadow box' so that you get excellent lighting. You'll be surprised at how much better and professional looking you pics will turn out..Also when you shoot a pic, if it dosen't look good, then shoot it over and over until you get it right. Try different angles, lighting, backgrounds. Pratice makes perfect and eventually it will become second nature...

My brother had the same issue. He reported at least a dozen other eBay sellers doing the same thing and after about a dozen emails, the final reply he got implied those sellers were 'power sellers' so eBay wasn't going to do a damn thing (wouldn't want to do anything to ruin all those listing and final value fees). He pestered them for over two months before they finally had enough and reinstated his account with no stipulations. This is why I hate eBay. They long ago gave up on the little guy in order to suck up to the power sellers and the larger companies selling overstocks. It's very hard to really make any money on eBay anymore unless you already have money to throw away for months on end. Sad fact is, none of the other auctions sites come close to matching eBay in terms of sellthrough.

I must say, as A Powerseller I experienced Poor service from Ebay, having my account limited because my feedback 'wasnt as good as it should be' I HAD 99.8% Positive feedback on 2400 feedback in over 18 months.

When they reinstated the account, I then told them to shove the Powerseller Status up their ar** and the majority of my advertising is done on Craigslist - if you want to know the secrets of craigslist click Link hidden: Login to view

I know run my Ebay account up to $300 before I pay anything, just incase the can my account, because I dont have a credit card on file and I havent linked my Paypal account, if they can me they can whistle for the money
I would definately say the people who are reporting you are your competitors. 8)

That's funny. I've been trying to get ebay to suspend one of the sellers account because I bought $600 worth of products from them and they ended up being counterfeits. I left the seller a negative feedback and ebay ended up taking the negative feedback away.

I have a conspiracy theory here, the person dobbing you in is an ebay shareholder and what happens is the person that gets dobbed has a look at the identical listings and says 'those traders are selling the same as me', so in turn dobs them in thinking by doing this they have a chance of capturing the bidders that now have to look somewhere else for the product, and it becomes a vicious cycle of people dobbing each other in. But who is really profiting from this process? It's not rocket science, but if you chose a product to sell that wasn't dubious you wouldn't be giving your money away.
