Listing Removed , But...

I have made listing of ebay for 2 product which is Nintendo DS Lite AND PSP 3000 AND these products was featured in LIGHT IN A BOX ( I signed up with them) which is a supplier listed in SaleHoo. I just got ebay removed these listings bcos according to ebay these product violated eBay policy.How can this happened since Salehoo is a partner of ebay and there are so many seller who is selling these products in ebay. Ebay is not being fair to me?

I'm using the descriptions about the product in my listing which is provided for reseller to use. Please advice what is my next course of action ? I sign up with Salehoo just recently and from SaleHoo I found out and I signed up Light In A Box to be a member.Below are the msg sent to me by ebay

Guideline: If the product you are selling is a copy of another work that you aren't authorized to copy, don't list the item. eBay prohibits the listing of hardware or software that enables duplication of copy-protected material. These copy-protected materials include (but are not limited to)
- Video games
- Software programs
- CD-ROMs
- DVDs
- CDs



Please advice me what to do !

First of all, Salehoo is not a partner of eBay. They are wholesale directories. Now regarding your question why your listing was removed, that is probably because you copied a description from another source which is prohibited by eBay if the owner of that description complained. Now, I think I might have an idea why your listing was removed. You said you are selling a nintendo ds lite and psp 3000 which you buy from light in a box? I think Light in a Box sells fake video consoles. Somebody, correct me if I am wrong regarding this info. But from what I can remember, they are based in china and they sell replica software and if strictly prohibited to sell that on ebay and if you list it, they will remove your listing.

The light in the box for the most part sells replica bootlegs. If eBay found out you were using those then you're out of there no warning.

They work good on I Offer trading market though as long as you use the ones that don't got logos. Good sales there.

There seems to be something going on with you either being reported to eBay by a competitor.

The other is eBay closing accounts with listings copied from LITB, knowing the items are not legit.

You will get slammed real hard on eBay selling counterfeit goods.

The problem I thinK with LITB is they sell games which are copied with their systems and eBay knows this.

DO NOT try and re-list the product again or you may find your self Perm. Banned from eBay.

Yes yes and yes... Light in the box sells fake copies of gaming hardware, and bootleg copies of gaming software. Just don't do business with them. In their website the deals look really good right? Well you know what they say? If it looks to good to be real it probably is. If I am not mistaken Light in the Box is in China which means it is hard for U.S. manufactures to seek legal counsel with regard to copyright infringments. Although it can be done.

I ran into the same problem with ebay and paypal. They locked my accounts after posting some products from DHGate. What I don't understand is if ebay and paypal are so concerned with these products, why are they allowing them, these chinese websites, to still have accounts with them! Sales volume maybe? All those nice fees they are collecting from DHGate & Light in the box? Double standard if you ask me. Many postings for the same products, descriptions, photos etc, on ebay are from 'powersellers' who are using the same suppliers and are not banned....why?

Well it may not be your listing then. You may be getting slammed by other sellers.

Its real simple , you can be selling a JERSEY, DESIGNER ITEM OR DVD ETC , you better know 100% it is licensed and not a Knockoff ..I know many people say well why are other people selling the same thing - the reason is they just have not been reported by VERO yet .. Most Trademark Owners now use ATTORNEYS who are basically CYBER COPS for them and just pull stuff down and it is up to you to prove it is legit and often after being VERO'ED you will get a DEMAND LETTER from the ATTORNEYS Demanding anywhere from $100 - $10,000 for the trademark violation and threats of a lawsuit if you dont pay up .I have been down this road before and had to get a attorney involved to prove my innocence and their Ignorance , it is really ashame that people with deadstock items like i specialize in get harrassed while people selling bootleg crap just keep on selling.

It seems to me after they lock your account and if you get the items authenicated you should be able to sue whoever sent you the letter,ebay, the lawyers and whoever else who ruins your ebay account and caused you loss in sales,and ruin your ebay reputation. The law does work both ways. I guess everyone who buys any branded item and resells on ebay is in violation of trade mark.

I think what everyone is saying here is cover all of your bases.

If you have a legit item for sale then sell it but know where it came from and have a receipt. If its from liquidation have a receipt from liquidation co. and a contact persons name and number available.

I have sold brand name clothing, but in my description, I stated it was from liquidation and I had all documentation. I also took closeup pictures of the labels and tags.

I am speaking more in terms of what is actually legal. Yes the companies may tag your item and have it pulled off eBay and your right, is it worth the trouble to take them to court, probably not.

Though I have read threads in othre forums where people have taken cos to court and won. But for most its not worth the trouble.

If a seller is selling jeans like Deisel and others he is more likely to bring attention.

But if a seller is selling a bunch of stuff and happens to have 3 or 4 Deisel jeans up amongst other items he is less likely to draw attention.

I have only had two items pulled and should have been as I was wrong. BUt all the other stuff I was left alone.

The point is there is nothing set in stone so be carefull - alot has to do when the cyber cops go through listings if yours is at the top of the search than Bingo ....It is also about how much you have listed i have 2,000- 3,000 listings all the time so the numbers game comes into effect - and most of my problems come from lesser know type of items .. Had a t-shirt from a 80's hair band was deadstock from Spencers in the mall - the listing got pulled for vero i contacted the Bands Vero contact who told me they never had a contract with the licensing company on the shirt - never thought the mall would sell fake items -- well 6 months later come to find out the Hair Band was letting a fan that runs their website do all their VEROS which is sad to think of that .. Well come to find out they did have a contract with the licensing company but the shirt was only released for test run in a small market .

yea buddy that is bad but my experience tells me something else was going on.

But if not than you are the perfect example of why eBay is failing in many ways.
