My eBay add was removed

Hi

i posted an add at ebay , i copied from DHGATE the data
and ebay after 2 days removed my add
this is what they wrote :

You recently listed the following Fixed Price listing:

290303255592 - LOTS 10pcs 4GB Hidden Spy Camcorder Pen DVR Cam


The listing was removed because it violated eBay policy. We notified members who placed bids on the item that the listing has been canceled.



The rights owner, Easy Commerce Global Limited, notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law.

Lots of issues with the Spy Pens at the moment. Its too do with a design orientated trademark issue.

You are buying these from DH Gate and brokering?

That is flippin' dangerous!

It means that you are acting as the middle man for the transaction, the supplier is the company you are buying from, the seller is the person you are selling to, and you are the one in the middle brokering the deal!

Your problem is that your supplier is caught up in a copyright infringement, and you as the broker can also get caught up in the issue as you are now a legal part of the transaction.

You should actually be grateful to ebay for closing the listing down, because if you get the company claiming the infringement coming after you, that will be SERIOUSLY bad news!

This is just another issue you have to watch out for when acting as a broker (drop shipper)

If you get involved in selling any product that infringes on another companies copyright/trademark, you can get yourself in so deep you won't be able to touch the bottom!

What has happened to common sense.

DH Gate is not a legit supplier, and you cannot do things like this an expect for it to be okay.

So you make a sale, (you are probably selling well over the odds, or being new to this whole thing making a slight loss after fees). Some customer buys from you, you then ship direct to customer. They then have to pay import + VAT.

Think they will be happy? I don't think so.

You then get a claim made, and will need to provide all sorts of proof. Chinese suppliers are notouriously unhelpful for this sort of thing, especially ones you have barely made contact with on DH Gate.

You have not even done any research on the product you are selling.

You are so bloody lucky its unbelievable, start over and forget DH Gate.

I've just saved you a lot of money and maybe made you a bit.
