Selling Counterfit goods?

Hello,

Well I was selling my last inventory of lacoste shirts when they got removed and then I got suspended for 7 days suposly. 7 days turned into a month when I send the papers to activate my account back. Later on November 2 I got a email from lacoste in Newyork NY United nation plaza saying about selling counterfit shirts and it can be punishable in millions. So Im freaked out I send them the demands they wanted what do you think will happen?

Demands
1) imediatly stop from selling lacoste
2) Suppliers info
3) Send inventory left
4) Written statement setting forth the # of lacoste branded productrs that you have purchased. THe prices I got them at and the prices I sold them and how many I have sold

What freaks me out is this

Intetional trafficking in counterfeit goods is also a crime punishable by up to 10 years im prison and a fine of up to 3 million for individuals and 5 million for corporations,.

Tell them you had no idea that they were counterfiet. The place you bought them from said they were genuine.

Act completely stupid. Give them all the info they want including supplier info. They will go after the supplier not the small time seller.

You need to consult a Lawyer Seriously. This is not a matter that you want to handle yourself. And hope it will go away.

Yeah, I feel for you mate, seriously. That is a shit of a position to find yourself in, but I'm with jimmy 100%

No time to play hard ball, give them your supplier on a plate, he will give them someone further up the chain and you will become a distant memory very quickly

and as jimmy said, give them averything they ask for!!

He doesn't have to act stupid, he has to be open and honest with these people and they will surely be able to see him for what he is, an unfortunate victim of the fraudsters of this world.
Let's hope they aren't as judgmental and condemning as you benjammin. Let's also hope this doesn't happen to you because the sympathy and advice may be a little thin on the ground :)

I think you miss the point laurarich, if you sell branded products that are so low in price that you yourself can profit on an auction site then you can't be ignorant of the fact that they may be replicas thereby leaving yourself open to litigation.
I really do want to sympathISE but someone has to be the matyr here and split this baby in half. My concern is all the other members contemplating doing something like this, it's too late for TripleG it's a foregone conclusion, he's in the shirt. The only variable here is the depth of shirt.
I don't want to appear sanctimonious but there most definitely is a lesson here for some of us.
Thanks for opening the thread TripleG you could indirectly be helping one of the Salehoo family out.

Bottom line here folks. Please dont immediately start bashing members of the forum. Even if it seems they knew what they were selling, not all sellers can tell the difference between a fake and an original.

You also need to note that some designers have chineese manufacturers produce thier products. There so called fakes are exactly the same as the original And made in the same production facility as the original. The only difference is that The chineese company was probably contracted for 100,000 units at a certain price and the facility had the material to make 130,000 units. These manufacturers have been well known for selling the 30,000 extra produced units to online vendors.

The only thing that makes most of these items Replicas Or Fakes. Is the fact that they were not authorized by the designer.

So your blaming an ebayer for selling replicas. Who are you to say they really knew they were replicas.

I bet you would be very suprised to know that many of your small local mall stores are selling these exact replicas and dont even know it.

I've heard the term 'if it sounds too good to be true then it probably isn't'. Now I'm talking about PRICE here, if traders are getting these at a good enough price to then resell them at a profit whether the product is the real McCoy or not then this should start to sound alarm bells ringing. Even the small local mall stores are subject to IP rights probably the big ones too. But when punters see a potential for profit then they lose sight of the wood through the trees. All I'm sayng is a little extra work checking could save traders the stress of what TripleG is going through. It could have been as simple as a phone call. People will always be divided on these types of issues and I think I've taken a reasoned approach but I see I AM alone here in my opinion and that's all it is. The trouble is if you get everyone singing from the same hymm book then it looks like as a group you condone that type of activity or say it's OK but only if you don't get caught, but if you do get caught well we're here for you, the ambulance at the bottom of the cliff. I'm not really having a go at anyone I'm saying prevention is better than a cure and a little bit of diligence is due. But I get the feeling that I could be excommunicated because Im not running with the pack on this one and OK I hear you jimmy_salehoo if you want me to shut up I will but at the beginning of the thread it said ANY opinions will count

Bottom line any aggressive behavior will not be tolerated. Weather it be insulting or defending. TripleG wanted Help, The point of his post was advise. Not criticizm, insults or arguments on intelligence.

I dont see anywhere in his post where he felt the need for a sociological debate on weather he was in the right or the wrong. He just wanted advise on what to do with his current situation.

And his open for opinions comment was stating he wanted opinions on what he could do to aviod trouble, and possibly avoid a lawsuit.

I have been very buzy with this problem and with work I hadnt checked the forum I dont know what happen here some bashing or insulting to another member just keep this forum clean salehoo doesnt want a bad reputation for helping people.

About my problem Im being I guess sued or charged 3,500 for my estimated profits

TripleG, have you had any resolution to the problem yet? Make sure you fight back to any potential law suites because some counterfeit stuff like even software is impossible for the average user to detect. They need to go after your supplier who is producing these items, not you...it isn't your fault.

Just stop selling it and ignore the threats, They are just trying to scare you. These are big time companies, they dont want to waste the time and money on lawyers for a small time seller, they probably will spend more money on lawyers then what u probably made in sales. just dont sell them anymore then you'll be all set
