What can I do to minimize my liability with the authorities in the US when selling brand name products?

Hi guys,

I’m getting ready to buy some brand name apparel from a wholesaler in China. The seller says that the items are authentic but I’m not sure that’s true.

If I make a purchase from this seller and the products turn out to be replicas, could I get in trouble with the authorities for selling fake items?

What can I do to minimize my liability with the authorities in the US?

The authorites go by the old saying ignorance is no excuse. If you are buying from China the chances of getting a fake are almost guaranteed. Even if they tell you it is real. Ask them for a certificate of Authorization to sell these items. Better yet don't source name brands from China.

dmdiscounts is perfectly right! The best thing you can do to minimize your liabilities down to zero is to NEVER source any brand name products in China. If they can produce replicas that look exactly like the real product, they can also produce fake authenticity documents/certificates to further lure you into buying from them.

Stay away from this supplier and from other Chinese suppliers offering brand name items.

What particular brands are you looking? Maybe we can help you search for suitable suppliers.

Thanks for the good advice.

The two brands that I was looking at where/are Hollister and AEROPOSTALE.

Now, as you may imagine, there is a plethora of products on eBay from these two brands. But I’m guessing they are probably not authentic either.

There have been several requests from other members for these two products. I will try searching for suppliers in the meantime I suggest using our 'Search in the forum' tab/function (on the upper left panel) to search for similar posts on the forum.
